Digital markets and online platforms: new perspectives on regulation and competition law

Across the world, regulators and policy makers are grappling with how to establish a competitive, safe and fair online environment that also safeguards users’ fundamental rights as citizens. Ahead of the European Commission’s Digital Markets Act (DMA), this book “Digital markets and online platforms: new perspectives on regulation and competition law“, presents CERRE’s latest contribution to the debate with concrete policy recommendations drawn from our recent research.

Together, the policy recommendations in this book present a roadmap that should be pursued for EU policy makers to safeguard competition and innovation in digital platform markets. They can be organised into three key areas for action: (i) More effective enforcement, (ii) increased transparency and switching easiness, and (iii) providing access to key innovation capabilities.

The book’s recommendations highlight that platform transparency and associated data collection by authorities, as well as data sharing by platforms (initiated through consumers or authorities), are the two most important overarching policy measures for platform markets in the near future. They facilitate enforcement, consumer choice, and innovation capabilities in the digital economy.

The contents of this book were presented and debated during a CERRE live debate with guest speakers Anne Yvrande-Billon (Arcep’s Director of Economic, Market and Digital Affairs), MEP Stéphanie Yon-Courtin (Vice-President of the European Parliament’s Committee on Economic and Monetary Affairs) and Javier Espinoza (Financial Times’ EU Correspondent covering competition and digital policy).

Jan Krämer is an Academic Co-Director at CERRE and a Professor at the University of Passau, Germany, where he holds the chair of Internet & Telecommunications Business.

Previously, he headed a research group on telecommunications markets at the Karlsruhe Institute of Technology (KIT), where he also obtained a diploma degree in Business and Economics Engineering with a focus on computer science, telematics and operations research, and a Ph.D. in Economics, both with distinction.

He is editor and author of several interdisciplinary books on the regulation of telecommunications markets and has published numerous articles in the premier scholarly journals in Information Systems, Economics, Management and Marketing research on issues such as net neutrality, data and platform economy, and the design of electronic markets.

Professor Krämer has served as academic consultant for leading firms in the telecommunications and Internet industry, as well as for governmental institutions, such as the German Federal Ministry for Economic Affairs and the European Commission.

His current research focuses on the role of data for competition and innovation in online markets and the regulation of online platforms.

Marc Bourreau is a Academic Co-Director at CERRE and Professor of Economics at Télécom Paris (Institut Polytechnique de Paris). He is affiliated with the interdisciplinary institute for innovation (i3) for his research.

His research focuses on competition policy and regulation, digital markets, and telecommunications.

Marc holds a Ph.D. in Economics from the University of Paris Panthéon Assas.

Sally Broughton Micova

University of East Anglia

Sally Broughton Micova is a CERRE Research Fellow and a Lecturer in Communications Policy and Politics at the University of East Anglia (UEA). She is also a member of UEA’s Centre for Competition Policy.

Her research focuses on media and communications policy in Europe.

She completed her PhD in the Department of Media and Communications at the London School of Economics and Political Science (LSE), after which she was an LSE Teaching and Research Fellow in Media Governance and Policy and Deputy Director of the LSE Media Policy Project.

Alexandre De Streel

Professor of EU Law, University of Namur

Alexandre de Streel is Academic Co-Director at CERRE and a professor of European law at the University of Namur and the Research Centre for Information, Law and Society (CRIDS/NADI). He is a Hauser Global Fellow at New York University (NYU) Law School and visiting professor at the European University Institute, SciencesPo Paris and Barcelona Graduate School of Economics, and also assessor at the Belgian Competition Authority.

His main areas of research are regulation and competition policy in the digital economy as well as the legal issues raised by the developments of artificial intelligence. Recently, he advised the European Commission and the European Parliament on the regulation of online platforms.

Previously, Alexandre worked for the Belgian Deputy Prime Minister, the Belgian Permanent Representation to the European Union and the European Commission (DG CONNECT). He holds a Ph.D. in Law from the European University Institute and a Master’s Degree in Economics from the University of Louvain.

Richard Feasey is a Senior Advisor within the CERRE Tech, Media, Telecom academic team, an independent consultant and a Senior Adviser to the Payment Systems Regulator in the UK.

He lectures at University College London and Kings College London.

Richard was previously the Public Policy Director of Vodafone Group plc from 2001 until 2013.

In October 2017, he was appointed to the panel of the UK’s Competition and Markets Authority and in October 2018 to the National Infrastructure Commission for Wales.

Jens-Uwe Franck is Professor of Law at the University of Mannheim and Senior Member of the Mannheim Centre for Competition and Innovation.

While his main research focus is in the field of competition law, he regularly engages in research projects on cross-cutting issues that concern the legal constitution of markets.

His research is characterised by a comparative approach and an openness to interdisciplinary work, particularly collaboration with economists. Current research projects focus on the challenges to market regulation posed by the rise of digital platforms.

Bruno Liebhaberg

Director General

Bruno Liebhaberg* is Director General of the think tank Centre on Regulation in Europe (CERRE). He is also currently the chair of the EU Observatory on Online Platform Economy.

He was a professor at the Université Libre de Bruxelles’ Solvay Brussels School of Economics and Management (SBS-EM ULB) from 1979 to 2018. Earlier in his career, he advised former European Commission President Jacques Delors on industry and R&D matters.

He holds a Master in Management Sciences from SBS-EM ULB and a PhD from the London School of Economics and Political Science.

Professor Martin Peitz is a CERRE Research Fellow and Professor of Economics at the University of Mannheim. He is also a Director of the Mannheim Centre for Competition and Innovation.

His policy research focuses on digital markets, regulation, and competition economics.

Martin holds a PhD in Economics from the University of Bonn.

Head of Data Policies research group
University of Passau

Daniel Schnurr leads the research group Data Policies at the University of Passau.

He received his Ph.D. in Information Systems from the Karlsruhe Institute of Technology, where he previously studied Information Engineering and Management (B.Sc. & M.Sc.).

He has published in leading journals in the areas of Information Systems and Economics on competition and cooperation in telecommunications markets, open access regulation as well as data sharing in digital markets.

His current research focuses on the rules and institutions that govern firms’ and consumers’ access to data.
