The Digital Markets Act (DMA) set out the ambitious goal of reaching contestability and fairness in digital markets. As we approach the 6 March 2024 deadline, regulators, gatekeepers, and third parties are jointly working on launching the DMA compliance process. At the same time, the Digital Services Act (DSA) is facing an important deadline, as the rules in the DSA will start applying to all online platforms from 17 February 2024.

When it comes to the DMA, the currently designated gatekeeper platforms will soon present their compliance plans to the Commission, which has exclusive competence to enforce the rules. In this, it is adopting a novel role as an enforcer of sector-specific regulation and is closely coordinating with national authorities, all of which raises unique institutional design questions. A non-exhaustive set of indicators, which will assist in determining whether gatekeepers comply with DMA obligations will accompany the implementation process, alongside an assessment of other appropriate and qualitative evidence.

In terms of the DSA, the designated Very Large Online Platforms and Search Engines (VLOPs and VLOSEs) have submitted their first reports demonstrating their method of conducting the so-called risk assessments and the associated societal risk-mitigation measures. How the Commission will assess these reports remains to be seen.

Within the frame of a wide-ranging project entitled the ‘CERRE Forum on the Digital Markets Act Compliance’, CERRE will organise the Digital Platforms Summit on 17 January 2024, between 10.30 and 18.00 CET, in Brussels. Leading policy makers, industry representatives, regulators, and civil society will discuss the interaction between the DMA and the contemporary EU regulatory framework, aligning new obligations with concurrent rules on data protection, confidential information and the DSA. What does a successful DMA and DSA implementation look like in practice and what tools can help us assess if it is working? Register and join us, in person or online, for a stimulating discussion.

An economist by training, Alberto Bacchiega joined the European Commission’s Directorate General for Competition in 2000. He has since then held a number of positions enforcing State aid and merger control in the telecoms, financial, pharmaceutical and chemical sectors. Since November 2021 he has been leading the directorate ‘Information, Communication and Media’ of DG COMP, which covers also the implementation of Digital Market Act.

An economist by training, Alberto Bacchiega joined the European Commission’s Directorate General for Competition in 2000. He practiced law as an attorney in Greece and became Legal Secretary (référendaire) at the Court of First Instance (now General Court of the EU) in 2004. He is a Legal Secretary at the Court of Justice of the EU since October 2021. He served under Judges S. Papasavvas (2004-2010), N. J. Forwood (2010-2015) and D. Gratsias (2015-present). He is experienced in Competition law, State aids, IP Law, Taxation, External commercial relations, Chemicals and judicial review in various other regulatory matters.

Since September 1, 2018, Martijn Snoep has been the Chairman of the Netherlands Authority for Consumers and Markets (ACM). Mr Snoep obtained his law degree from Erasmus University Rotterdam. Until his appointment at ACM, he worked at De Brauw Blackstone Westbroek for 28 years. Operating from both their Amsterdam and Brussels locations, Mr Snoep gave advice to businesses about the application law in the Netherlands and abroad. As managing partner, he stood at the helm of the firm between 2010 and 2016.

Rita Wezenbeek is Director of Platforms Policy and Enforcement in DG CONNECT. The Platforms Directorate is in charge of policies and regulations applicable to online intermediary services, including the supervision of the implementation and enforcement of the Digital Services Act and the Digital Markets Act (the latter jointly with DG COMP). These two new Regulations establish strong rules to ensure a safe, fair and open platform economy for European citizens and businesses, and give the Commission significant regulatory powers over “gatekeepers” and very large platforms and search engines.

Rita joined the European Commission in 2002. Before moving to DG CONNECT in December 2020, she was the head of the units dealing with Anti-Trust and Telecommunications (2017-2020) and Retail Financial Services and Payment Systems (2010-2017) in DG Competition.

Before joining the Commission, Rita worked for sixteen years as a private lawyer, specialized in European and corporate law, in a Dutch/ Belgian law firm. She also was a Member of the Commission on European Integration, an independent advisory body on foreign policy to the Dutch government and Parliament.

Kush Amlani is Global Competition & Regulatory Counsel at Mozilla, leading the competition work. He joined the BBC from SJ Berwin LLP (later Kings & Wood Mallesons) where he worked on competition cases in sectors such as energy, media, telecoms and pharmaceuticals, including the pay-for-delay cases before the European Commission and the Court of Justice. Kush studied law at the University of Warwick and Université Montesquieu Bordeaux IV.

Antoine is a Deputy Head of Unit in the European Commission’s Directorate General for Competition in the directorate J in charge of the Digital Markets Act (DMA) enforcement. Previously, Antoine worked in the area of merger control focusing on digital and telecom transactions. Before joining the European Commission, Antoine worked as an associate in Freshfields Bruckhaus Deringer’s Competition Law department in Brussels and as a case handler in the French Competition Authority. Antoine is a visiting lecturer at Sciences Po Paris.

She holds a law degree from Université Panthéon-Assas in Paris and an LLM in International Business law from McGill University in Montreal. Lucia spent her entire professional career devoted to competition law enforcement, in particular merger control, and to a lesser extent, antitrust.
Previously, she served in the private office of the Executive Vice-president of the European Commission for Competition and Europe fit for Digital Age, Margrethe Vestager. In addition to her experience at the European Commission, in 2009 Lucia spent three months at the Federal Trade Commission as an exchange official. Lucia was featured amongst 26 women at the forefront of global antitrust in GCR Women in Antitrust 2016 : Enforcers and in 30 in their 30s Notable Women Competition Professionals in Enforcement in 2017.

Marc Bourreau is a Academic Co-Director at CERRE and Professor of Economics at Télécom Paris (Institut Polytechnique de Paris). He is affiliated with the interdisciplinary institute for innovation (i3) for his research.

His research focuses on competition policy and regulation, digital markets, and telecommunications.

Marc holds a Ph.D. in Economics from the University of Paris Panthéon Assas.

Marc Bourreau is a Academic Co-Director at CERRE and Professor of Economics at Télécom Paris (Institut Polytechnique de Paris). He is affiliated with the interdisciplinary institute for innovation (i3) for his research.

His research focuses on competition policy and regulation, digital markets, and telecommunications.

She has been actively engaged in European regulatory debates for the last 15 years, prior to which she worked as a lawyer at Clifford Chance LLP in London for 8 years.

She got her bachelors’ degree from Harvard University and a masters’ degree from Columbia University, and a law degree from Oxford University.

Sally Broughton Micova is a CERRE Academic Co-Director and an Associate Professor in Communications Policy and Politics at the University of East Anglia (UEA). She is also a member of UEA’s Centre for Competition Policy.

Her research focuses on media and communications policy in Europe.

She completed her PhD in the Department of Media and Communications at the London School of Economics and Political Science (LSE), after which she was an LSE Teaching and Research Fellow in Media Governance and Policy and Deputy Director of the LSE Media Policy Project.

Sally Broughton Micova is a CERRE Academic Co-Director and an Associate Professor in Communications Policy and Politics at the University of East Anglia (UEA). She is also a member of UEA’s Centre for Competition Policy.

Her research focuses on media and communications policy in Europe.

Chiara Caccinelli is Deputy Head of the Economic Analysis and Digital Affairs Unit at Arcep (the French regulator for electronic communications, postal and print media distribution services) and Co-chair of the Digital Markets WG at BEREC. From 2019 to 2022 she co-chaired BEREC’s Market and Economic Analysis WG. Before joining Arcep and BEREC, Chiara was Deputy to the Director of the Governance and Regulation Programme and the Club of Regulators in Paris (2015-2019), and simultaneously carried out academic research on economic and competition challenges in the digital economy. Previously, she was Programme Manager and Research Associate at the Florence School of Regulation (European University Institute, 2011-2015) and Analyst and Consultant in European Affairs in Milan and Brussels (2009-2010). Chiara holds an MSc in Economics of Network Industries and Digital Economy from Paris Dauphine University – PSL, and an MA in European Affairs from the University of Perugia.

In the European Commission she has also been for several years a case handler in DG Competition in the ICT area.

Before joining the Commission, she was assistant professor at Tilburg University, affiliated with the Tilburg Law and Economics Center (TILEC). She holds a Master’s Degree in law from Luiss University, a Master’s in law and economics from the universities of Rotterdam, Hamburg and Berkeley and a PhD in institutional economics from La Sapienza University. Her academic work focused on regulation and competition in the telecoms and digital sectors, including Internet governance and network neutrality, as well as on the economics of contract law. Besides her position in the European Commission, she is currently also visiting professor at the College of Europe in Bruges for the seminar on the Digital regulation of the single market.

Alexandre de Streel is the Academic Director of the digital research programme at the Brussels think-tank Centre on Regulation in Europe (CERRE), professor of European law at the University of Namur and visiting professor at the College of Europe (Bruges) and SciencesPo Paris. He sits in the scientific committees of the Knight-Georgetown Institute (US), the European University Institute-Centre for a Digital Society (Italy) and the Mannheim Centre for Competition and Innovation (Germany).

His main research areas are regulation and competition policy in the digital economy (telecommunications, platforms and data) as well as the legal issues raised by the developments of artificial intelligence. He regularly advises the European Union and international organisations on digital regulation.

Previously, Alexandre held visiting positions at New York University Law School, the European University Institute in Florence, Panthéon-Assas (Singapore campus), Barcelona Graduate School of Economics and the University of Louvain. He also worked for the Belgian Deputy Prime Minister, the Belgian Permanent Representation to the European Union, and the European Commission. He has also been the chair of the expert group on the online platform economy, advising the European Commission.

Richard Feasey is a CERRE Senior Adviser, an Inquiry Chair at the UK’s Competition and Markets Authority and Member of the National Infrastructure Commission for Wales.

He lectures at University College and Kings College London and the Judge Business School.

He has previously been an adviser to the UK Payments Systems Regulator, the House of Lords EU Sub-Committee and to various international legal and economic advisory firms.

He was Director of Public Policy for Vodafone plc between 2001 and 2013.

Amelia Fletcher CBE is a Professor of Competition Policy at the Centre for Competition Policy, University of East Anglia and co-editor of the Journal of Competition Law and Economics. She also acts as an expert witness.

She has been a Non-Executive Director at the UK Competition and Markets Authority (2016-2023), Financial Conduct Authority (2013-20) and Payment Systems Regulator (2014-20), and a member of Ofgem’s Enforcement Decision Panel (2014-2022). She has also been a member of DG Comp’s Economic Advisory Group on Competition Policy, and was a member of the Digital Competition Expert Panel, commissioned by the UK Treasury and led by Jason Furman, which reported in March 2019.

She was previously Chief Economist at the Office of Fair Trading (2001-2013), where she also spent time leading the OFT’s Mergers and Competition Policy teams. Before joining the OFT, she was an economic consultant at Frontier Economics (1999-2001) and London Economics (1993-1999).

She has written and presented widely on competition and consumer policy. In her ongoing research, Amelia has a particular interest in the implications for competition and consumer policy of behavioural economics and online markets.

He holds an MA in European Political and Administrative Studies from the College of Europe, as well as an executive MBA from Imperial College, focusing on digital innovation and platform convergence.

Daniel Friedlaender started as a political staffer in Canada prior to moving to Europe, first working in strategic communications before representing the global recording industry.

In 2016 he was hired to open and lead the new office of the Sky Group (later part of Comcast) in Brussels. As Head of the EU Office and Sky’s European Affairs Director, Daniel Friedlaender worked across the creative, cultural, telecoms, and technology sectors. In this role, he also chaired the European VoD Coalition and sat on the board of the Association of Commercial Television, as well as many other organisations.

A Swiss and Canadian national, Daniel Friedlaender has been working in public affairs and policy for over 20 years. He holds an MA in European Political and Administrative Studies from the College of Europe, as well as an executive MBA from Imperial College, focusing on digital innovation and platform convergence.

Jan Krämer is an Academic Co-Director at CERRE and a Professor at the University of Passau, Germany, where he holds the chair of Internet & Telecommunications Business.

Previously, he headed a research group on telecommunications markets at the Karlsruhe Institute of Technology (KIT), where he also obtained a diploma degree in Business and Economics Engineering with a focus on computer science, telematics and operations research, and a Ph.D. in Economics, both with distinction.

He is editor and author of several interdisciplinary books on the regulation of telecommunications markets and has published numerous articles in the premier scholarly journals in Information Systems, Economics, Management and Marketing research on issues such as net neutrality, data and platform economy, and the design of electronic markets.

Professor Krämer has served as academic consultant for leading firms in the telecommunications and Internet industry, as well as for governmental institutions, such as the German Federal Ministry for Economic Affairs and the European Commission.

His current research focuses on the role of data for competition and innovation in online markets and the regulation of online platforms.

Previously, he worked on digital transformation for an internal consultancy of the French government. He is a former Director General of ARCEP, France’s electronic communications and postal services regulator. He previously spent eight years at the World Bank in infrastructure financing and was (briefly) public policy director for Google France for a few months in 2017. He studied industrial economics and regulation at Ecole Polytechnique, ENSAE, and Toulouse School of Economics.

Fiona M. Scott Morton is the Theodore Nierenberg Professor of Economics at the Yale University School of Management where she has been on the faculty since 1999.  Her area of academic research is industrial organization, with a focus on empirical studies of competition.

The focus of her current research is competition in healthcare markets and the economics of antitrust. From 2011-12 Professor Scott Morton served as the Deputy Assistant Attorney General for Economic Analysis (Chief Economist) at the Antitrust Division of the U.S. Department of Justice, where she helped enforce the nation’s antitrust laws.

At Yale SOM she teaches courses in the area of competitive strategy and antitrust economics. She served as Associate Dean from 2007-10 and has won the School’s teaching award three times. She founded and directs the Thurman Arnold Project at Yale, a vehicle to provide more antitrust programming and policy projects to Yale students.
