Data Act: How to Finalise the Negotiations?

The Data Act proposal has generated substantial policy debate over the past months. With co-regulators reaching the final compromise text and being close to starting the trilogues, industrial stakeholders are calling for more time to carefully consider the consequences of the legislation. A fundamental piece of the EU data strategy that covers business to business (B2B), business to consumer (B2C), and business to government (B2G) data sharing, as well as cloud switching, the Data Act aims to foster access to and use of data by unlocking data from connected products in a market where, according to the Commission, about eighty percent of the industrial data collected is never used.

The text proposes a horizontal regulation, affecting all players. It has, however, been criticised for being overly complex and creating legal uncertainty. The three reports in CERRE’s Improving the Data Act project examine the B2B/B2C, cloud switching, and B2G provisions from an economic perspective and make recommendations for the balancing of interests and the creation of a legal framework that can effectively reach the regulatory goal.

The project will conclude with a hybrid, public event that will present the three reports and discuss the latest developments in the file. Will the Data Act succeed in unlocking the value of data? Does it strike the right balance between preserving innovation incentives and incentivising data sharing? Are the provisions overly complex for a horizontal regulation? Do they overburden smaller firms? Should the B2G obligations apply only to ad hoc data transfers? How will compensation be determined?

To get answers to these questions, join us on March 28, from 14.00 to 17.00 CET, in Brussels or online, for a stimulating discussion with the representatives from the European institutions, national regulators, industry players, and the CERRE academic team.

This event is free and open to all, but registration is required. Viewers will have the chance to submit questions for the panellists during the event.

Matt Allison is Senior Public Policy Manager at Vodafone Group, covering Data, Platforms and Artificial Intelligence. Matt has worked at the cutting edge of tech public policy for a decade in a variety of roles spanning industry, consultancy and NGOs. During this time, he has grappled with some of the key public policy challenges facing the technology sector and helped shape the policy landscape as governments and regulators look to confront and harness the rapid growth of digital services.

At Vodafone, Matt is responsible for developing policy and regulatory strategies for data, AI and digital platforms, influencing new regulation and creating alignment between Vodafone’s local market activities. Prior to joining Vodafone Matt was a Manager in the International Public Policy team at Access Partnership, the leading government affairs consultancy in the technology sector where he helped to establish and grow the firm’s Brussels practice, as well as working in the NGO sector focused on the development of Internet safety policy. Matt holds a Master’s degree in Politics, Security and Integration from the School of Slavonic and East European Studies (SSEES), part of University College London. His studies focused on Russian and Eastern European politics, European integration and national identity. Prior to this Matt obtained a Bachelor’s degree in History at the University of East Anglia where he specialised in Soviet history and English economic and social history.

Maya Bacache joined the Executive Board of Arcep on 1 October 2019, the French regulator for telecommunications, postal services, and distribution of the press.

Pierre Chastanet is Head of the Unit for Cloud and Software in the European Commission and oversees the development and implementation of the European policies on Cloud and Free Flow of Data.

Mr. Chastanet has been working for 16 years at the European Commission in various management and policy development assignments, in the areas of cybersecurity, digital privacy, ICT for societal challenges, green ICT, and telecom innovation.

Prior to that, Mr. Chastanet gained more than 11 years of ICT experience, mostly in various IT management positions in a large multinational company.

He holds an MSc in Telecommunication Engineering from Telecom ParisTech, an M.A. in International Politics from the Free University of Brussels (ULB), and a BSc in Economics from the London School of Economics and Political Science.

Previously, he headed a research group on telecommunications markets at the Karlsruhe Institute of Technology (KIT), where he also obtained a diploma degree in Business and Economics Engineering with a focus on computer science, telematics and operations research, and a Ph.D. in Economics, both with distinction.

He is editor and author of several interdisciplinary books on the regulation of telecommunications markets and has published numerous articles in the premier scholarly journals in Information Systems, Economics, Management and Marketing research on issues such as net neutrality, data and platform economy, and the design of electronic markets.

Professor Krämer has served as academic consultant for leading firms in the telecommunications and Internet industry, as well as for governmental institutions, such as the German Federal Ministry for Economic Affairs and the European Commission.

His current research focuses on the role of data for competition and innovation in online markets and the regulation of online platforms.

Heiko Richter is a senior research fellow at the Max Planck Institute for Innovation and Competition in Munich (Germany). He received his master’s degree in business administration from the University of Mannheim, completed his legal state examinations and PhD in Berlin, and holds an LL.M. from Columbia University, New York. His research addresses the regulation of data and information, copyright law, and competition law. He advises German and EU policy makers in these areas.

Heiko Richter is a senior research fellow at the Max Planck Institute for Innovation and Competition in Munich (Germany). Veronika Chvala Vinklarkova is an attaché at the Czech Permanent Representation to the EU with a focus on the digital and telecommunications agenda. She joined the Permanent Representation in the summer of 2021. Before that, she was working at the Office of the Government of the Czech Republic in the European Digital Agenda Unit.

During the Czech Presidency, Veronika was chairing one of the preparatory bodies in the Council – the Working Party for Telecommunication and Information Society. This particular working party is negotiating crucial digital and telecommunications legislative and non-legislative proposals, including the Data Act. As part of the Czech Presidency, Veronika also concluded negotiations of the Interinstitutional declaration on Digital rights and Principles and the Decision establishing the Digital Decade Policy Program 2030.
