Digital Markets Act: Institutional design and enforcement methods

The European Commission’s proposals for the Digital Markets (DMA) and Digital Services (DSA) Acts are under discussion in Brussels and the Member States. Before the publication of the Commission’s proposals, CERRE produced a range of influential recommendations for the DMA and the DSA, and the same academics have since published a first assessment of the DMA proposal.

To delve into and debate specific aspects of the DMA and DSA package, CERRE is hosting a series of livestreamed online ‘rendez-vous’ events throughout the first half of 2021. The first ‘rendez-vous’ unpacked and debated the objectives and criteria for large gatekeeper platforms, the second focused on prohibitions and obligations to be imposed. This is the third in the series on the DMA, during which the institutional design and enforcement methods of the Commission’s DMA proposal will be discussed.

CERRE’s DMA recommendations, released ahead of the Commission proposal in November 2020 and referenced in the European Parliamentary Research Service’s (EPRS) briefing “Regulating digital gatekeepers: Background on the future digital markets act”, suggested new ways of enforcement that are more participatory, experimental, data-based and technological. In their first assessment of the DMA proposal, authors of the CERRE recommendations agree that centralised enforcement is appropriate, but they recommend a bigger role for national independent authorities and modes of oversight and enforcement that are more aligned with the DSA proposal.

This – and much more – to be discussed amongst key players from the online platform and telecommunication industries, national regulators, policy makers, international stakeholders and academics from Europe and the US on Thursday 4 March, 16:00 CET. The event, moderated by CERRE Tech, Media, Telecom & Mobility Director Lara Natale, will be livestreamed on this page and the CERRE YouTube channel. Dragan Jovanovic is a Senior Manager with Deutsche Telekom AG in Bonn, part of the group’s Public & Regulatory Affairs team. In his role at Deutsche Telekom, his focus is on regulatory strategy and policy issues in digital platform markets and mergers and antitrust in the ICT sector.

Before joining Deutsche Telekom, he was an economist with DG COMP’s Chief Economist Team dealing with EU merger and antitrust cases. He holds a PhD from Heinrich-Heine University Düsseldorf in Competition Economics and Industrial Organization.

Filippo Lancieri is a Postdoctoral Researcher at the ETH Zurich Center for Law & Economics and a Research Fellow at the Stigler Center at the University of Chicago Booth School of Business. Filippo’s work focuses on the challenges associated with the development of a cohesive regulatory framework for the digital economy. His focus is mostly on understanding the law in action: how different policies and enforcement actions can change behavior on the ground.

 

Filippo Lancieri is a Postdoctoral Researcher at the ETH Zurich Center for Law & Economics and a Research Fellow at the Stigler Center at the University of Chicago Booth School of Business. Filippo’s work focuses on the challenges associated with the development of a cohesive regulatory framework for the digital economy. Anaïs Le Gouguec works currently at Arcep as Head of the Economic analysis and digital intelligence Unit. She focuses notably on market analyses and platforms regulation.

She was also co-chair of the BEREC (Body of European Regulators for Electronic Communication) Market Economic Analysis expert working group.

Ms Le Gouguec holds Master’s degrees in Finance and Economics from LSE and in Econometrics and Quantitative Economics from Ensae ParisTech.

Phillip Malloch has been Director of Economic & Social Policy, EU Affairs, at Facebook since October 2019.

Previously, he served as Principal Advisor to the CEO at Telia Company. Prior to that, he worked as a public affairs and communications executive.

Mr Malloch has experience in industrial, political and executive communications and strategic engagement as well as a deep knowledge and understanding of digital communications and internet business strategy. Among other things, he has worked as part of leadership projects in M&A, strategy, CEO outreach, trade associations leadership, global political summits and outreach.

Giorgio Monti is a CERRE Research Fellow and Professor of Competition Law at Tilburg Law School.

He began his career in the UK (Leicester 1993-2001 and London School of Economics (2001-2010) before taking up the Chair in competition law at the European University Institute in Florence, Italy (2010-2019). While at the EUI he helped establish the Florence Competition Program which carries out research and training for judges and executives. He also served as Head of the Law Department at the EUI.

His principal field of research is competition law, a subject he enjoys tackling from an economic and a policy perspective.

Together with Damian Chalmers and Gareth Davies he is a co-author of European Union Law: Text and Materials (4th ed, Cambridge University Press, 2019), one of the major texts on the subject. He is one of the editors of the Common Market Law Review.
