New ways of oversight for the digital economy

Oversight is a key component of successful regulation. Governments around the world are seeking to regulate digital platforms and – even if the regulatory framework is correct – success could be undermined by a lack of effective oversight. This CERRE Tech, Media, Telcom issue paper discusses how public authorities can oversee the application of the rules by digital platforms and encourage the emergence of an “ecosystem of oversight” with a cooperative relationship between oversight bodies, the platforms and their users to achieve public interest objectives.

With the European Commission’s landmark proposals for the Digital Markets and Digital Services Acts, the supervision of the platform economy in the European Union is set to change. The oversight of platforms is particularly challenging given the key characteristics of the platform economy, such as their global reach, information asymmetry, complex business models and their impact on fundamental rights. This means new ways of oversight need to be applied.

Authors Alexandre de Streel and Michèle Ledger aim to put forward some options for the oversight of the platform economy and to stimulate discussion, setting out the principles for good regulatory framework, authorities and oversight, making proposals for an “ecosystem of oversight”, and suggesting roles for digital technologies, big data and Artificial Intelligence.

This issue paper was presented and debated during a CERRE online webinar on 23 February 2021.

Professor of EU Law, University of Namur

Alexandre de Streel is Academic Co-Director at CERRE and a professor of European law at the University of Namur and the Research Centre for Information, Law and Society (CRIDS/NADI). He is a Hauser Global Fellow at New York University (NYU) Law School and visiting professor at the European University Institute, SciencesPo Paris and Barcelona Graduate School of Economics, and also assessor at the Belgian Competition Authority.

His main areas of research are regulation and competition policy in the digital economy as well as the legal issues raised by the developments of artificial intelligence. Recently, he advised the European Commission and the European Parliament on the regulation of online platforms.

Previously, Alexandre worked for the Belgian Deputy Prime Minister, the Belgian Permanent Representation to the European Union and the European Commission (DG CONNECT). He holds a Ph.D. in Law from the European University Institute and a Master’s Degree in Economics from the University of Louvain.

Michèle Ledger is a researcher at the CRIDS research centre of the University of Namur and leads Cullen International’s Media regulatory intelligence service.

She has been analysing the EU regulatory framework governing the audiovisual and digital economy sectors and the national implementation of these frameworks for many years. She has participated in many studies, conferences and publications.
