Should the Digital Markets Act include interoperability obligations for digital gatekeepers’ platform services?

How do we restore contestability and fairness in digital markets? Policy makers frequently discuss whether interoperability obligations are an appropriate regulatory tool and already, over a decade ago, the European Commission identified the lack of interoperability as one of the most significant obstacles to competition. But what progress has been made and what regulatory measures are being taken to encourage market players to pursue interoperability-friendly business policies?

The Digital Markets Act (DMA) aims to ensure that large online platforms behave in a fair way online and do not stifle emerging competition by smaller rivals or complementors. The European Commission’s proposal foresees only select vertical interoperability obligations, inviting complementors to provide independent payment and identification services as well as app stores. However the European Parliaments’ amendments also include horizontal obligations, which would require interoperability between messenger services.

Would those interoperability obligations really stimulate contestability in digital markets – or could some of these obligations indeed by harmful to competition and innovation?

Join us on 21 March from 15:30 to 17:00 for a presentation of the recommendations made in CERRE’s latest report ‘Interoperability in Digital Markets’ by academics Jan Krämer (CERRE Academic Co-director and University of Passau) and Marc Bourreau (CERRE Academic Co-director and Télécom Paris), followed by a panel discussion featuring representatives from regulator bodies, digital industries, and civil society.

This event is free and open to all but registration is required.

Jan Krämer is an Academic Co-Director at CERRE and a Professor at the University of Passau, Germany, where he holds the chair of Internet & Telecommunications Business.

Previously, he headed a research group on telecommunications markets at the Karlsruhe Institute of Technology (KIT), where he also obtained a diploma degree in Business and Economics Engineering with a focus on computer science, telematics and operations research, and a Ph.D. in Economics, both with distinction.

He is editor and author of several interdisciplinary books on the regulation of telecommunications markets and has published numerous articles in the premier scholarly journals in Information Systems, Economics, Management and Marketing research on issues such as net neutrality, data and platform economy, and the design of electronic markets.

Professor Krämer has served as academic consultant for leading firms in the telecommunications and Internet industry, as well as for governmental institutions, such as the German Federal Ministry for Economic Affairs and the European Commission.

His current research focuses on the role of data for competition and innovation in online markets and the regulation of online platforms.

Marc Bourreau is a Academic Co-Director at CERRE and Professor of Economics at Télécom Paris (Institut Polytechnique de Paris). He is affiliated with the interdisciplinary institute for innovation (i3) for his research.

His research focuses on competition policy and regulation, digital markets, and telecommunications.

Marc holds a Ph.D. in Economics from the University of Paris Panthéon Assas.

Bruno Liebhaberg is Executive Chairman of the think tank Centre on Regulation in Europe (CERRE) which he founded in 2010.

From 2018 to 2021, he was also the first Chairman of the European Union Observatory on the Online Platform Economy. He is also an Honorary Professor at the Université Libre de Bruxelles’ Solvay Brussels School of Economics and Management (SBS-EM ULB) where he taught from 1979 to 2018. Earlier in his career, he advised former European Commission President Jacques Delors on industry and R&D matters related to the completion of the EU Single Market.

He holds a Master’s in management sciences from SBS-EM ULB and a Ph.D. in Industrial Relations from the London School of Economics and Political Science.

Laura Seritti is Head of Public Policy at Snap Inc, where she leads the EU public policy and regulatory work in Brussels.

She previously worked on competition policy at the European Commission (DG Competition), focusing on merger control and state aid, and as a public policy consultant. She also carried out research on internal market, digital policy and consumer protection as a visiting researcher at the Perelman Centre of Law of the Université Libre de Bruxelles.

Laura holds a Degree in economics from Bocconi University, an MA in European economic studies from the College of Europe in Bruges and an LLM in European law from Université Libre de Bruxelles.
