The DMA: EU, US and global perspectives

The Digital Markets Act (DMA), proposed by the European Commission in December 2020 and now under discussion in the European Parliament and Council, marks a new era for the regulation of online platforms in Europe, along with the Digital Services Act (DSA).

Drawing from CERRE’s recommendations for the DMA and DSA, released prior to the Commission proposal, and the same authors’ first assessment of the DMA, CERRE hosted a series of ‘rendez-vous’ events to discuss the two proposals in detail with industry, regulatory authorities, experts and policy makers.

To wrap up a series of valuable debates throughout the first quarter of 2021, CERRE will host a high-level discussion of the DMA on Tuesday 4 May, 16:00-17:30 CEST. 

The event will kick off with two political conversations back-to-back, hosted by CERRE Director General Bruno Liebhaberg. The first with French Minister of State for the Digital Transition and Electronic Communications, Cédric O, and the second with Member of the European Parliament, Andreas Schwab.

There will also be a panel discussion between Dr. Cristina Caffarra and Professor Harry First, moderated by CERRE Tech, Media, Telecom & Mobility Director, Lara Natale. Professor Alexandre de Streel will then reflect on the discussions that emerged from CERRE’s ‘rendez-vous’ series and DMA recommendations.

This event is open to all and will be livestreamed on this page as well as the CERRE YouTube channel. Viewers will have the chance to ask questions via Slido during the event using the code #CERREDMA. Catch up on the four events earlier in the ‘rendez-vous’ series here.

Dr Caffarra holds a PhD in Economics from Oxford University and is an expert in the application of applied theory and industrial economics to competition law, as well as the empirical analysis of markets in the context of competition investigations. She has provided economic advice to companies on landmark cases in merger control, assessment of vertical restraints, finding of dominance, evaluation of abusive conduct, and several other competition/antitrust issues including bundling, tying, rebates, price discrimination, other forms of potentially exclusionary conduct, intellectual property rights, information exchanges, collusion and the assessment of damages.

She has directed and coordinated empirical and theoretical economic analyses on several of the high profile cases of the last 20 years before the European Commission (including matters involving Google, Microsoft, Apple, Amazon, Samsung, Hollywood Studios, Sky and others), the competition authorities of several member states, as well as the Courts in multiple jurisdictions. She has provided expert economic advice and testimony before the General Court in Luxembourg, the Competition Appeal Tribunal in the UK, the High Court in London, the High Court in Dublin, the Competition Appeals Tribunal in South Africa, and various other courts and arbitration in several litigated competition matters. She has particular experience in the economics of platforms and digital – including work on payment schemes for Visa, on search, Android, local search and other matters adverse to Google, as well as work for Apple, Amazon, Uber, Microsoft and multiple others.

Dr Caffarra has worked for research institutions both in Italy and at Oxford. She is on the Editorial Board of the European Competition Law Journal, as well as on the Advisory Board of the Journal of European Competition Law & Practice (OUP). She lectures in competition economics as an Visiting Professor at UCL and has published articles for competition journals as well as presented papers on the economics of competition law at numerous international and academic conferences.

Alexandre de Streel is Academic Director at CERRE and a Professor of European Law at the University of Namur and the Research Centre for Information, Law and Society (CRIDS/NADI). Since April 2021, he is also the Chair of the EU Observatory on Online Platform Economy.

He is a Hauser Global Fellow at New York University (NYU) Law School and visiting professor at the College of Europe and SciencesPo Paris, and also assessor at the Belgian Competition Authority.

His main areas of research are regulation and competition policy in the digital economy as well as the legal issues raised by the developments of artificial intelligence. Recently, he advised the European Commission and the European Parliament on the regulation of online platforms.

Previously, Alexandre worked for the Belgian Deputy Prime Minister, the Belgian Permanent Representation to the European Union and the European Commission (DG CONNECT). He holds a Ph.D. in Law from the European University Institute and a Master’s Degree in Economics from the University of Louvain.

Harry First
Charles L. Denison Professor of Law
New York University School of Law

Harry First is the Charles L. Denison Professor of Law at New York University School of Law and Co-Director of the law school’s Competition, Innovation, and Information Law Program.

He was twice a Fulbright Research Fellow in Japan and taught antitrust as an adjunct professor at the University of Tokyo.

From 1999-2001 he served as Chief of the Antitrust Bureau of the Office of the Attorney General of the State of New York.

Professor First’s recent scholarly writing includes a study of the Microsoft litigation, The Microsoft Antitrust Cases: Competition Policy for the Twenty-first Century (co-authored with Andrew Gavil), the casebook Free Enterprise and Economic Organization: Antitrust (co-authored with John Flynn and Darren Bush), and various book chapters and law review articles.

Professor First is a contributing editor of the Antitrust Law Journal, foreign antitrust editor of the Antitrust Bulletin, a member of the Executive Committee of the Antitrust Section of the New York State Bar Association, and a member of the Advisory Board and a Senior Fellow of the American Antitrust Institute.

Director General

Bruno Liebhaberg* is Director General of the think tank Centre on Regulation in Europe (CERRE). In 2018-2021, he was the first Chairman of the EU Observatory on the Online Platform Economy.

He was a professor at the Université Libre de Bruxelles’ Solvay Brussels School of Economics and Management (SBS-EM ULB) from 1979 to 2018. Earlier in his career, he advised former European Commission President Jacques Delors on industry and R&D matters.

He holds a Master in Management Sciences from SBS-EM ULB and a PhD from the London School of Economics and Political Science.

Cédric O is the French Secretary of State for Digital Transition and Electronic Communications.

Prior to this, he was Secretary of State for Digital (2019-2020) and joint advisor to the President of the Republic and the Prime Minister, in charge of public participation and the digital economy (2017-2019).

Andreas Schwab

Member of the European Parliament
European People’s Party

Andreas Schwab MEP is a member of the European People’s Party and sits on the IMCO Committee, European Parliament.

He was elected board member of the CDU South Baden; Chairman of the German-French Forum, Fibourg; and member of the advisory board of the Albert-Ludwigs-University Fribourg.

Mr. Schwab has been an MEP since 2004 and has previous experience in both the public and private sector.

He has a Doctorate in law and a Master’s degree from the University of Wales.
