As the European Commission is evaluating whether its competition rules are fit for the digital age, CERRE hosted a live debate for the launch of Nicolas Petit’s new book: “Big Tech and the Digital Economy – The Moligopoly Scenario” (OUP, July 2020).

During this webinar, Professor Petit (Joint Chair in Competition Law at the European University Institute and the Robert Schuman Center for Advanced Studies) presented his new book and debated competition rules in the digital age with the President of the French Competition Authority, Isabelle de Silva, and CERRE’s Joint Academic Director, Professor Alexandre de Streel (University of Namur).

The book challenges policymakers’ approach to Big Tech’s regulation. It proposes to channel competition policy and market regulation toward certain types of markets that have tipped, and where competitive pressure is insufficient to incentivise digital firms to compete in untipped markets. Professor Petit considers that mainstream competition theory and antitrust tools are conceptually and methodologically inadequate to properly address the dynamics of the digital economy markets as they do not capture the existence and intensity of the multi-dimensional rivalry between technology firms.

Professor Petit is also Invited Professor at the College of Europe in Bruges, and a member of the European Commission High-Level Expert Group on Artificial Intelligence. He was previously a panel member with the Belgian competition authority. He is the co-author of EU Competition Law and Economics (Oxford University Press, 2012) and the author of Droit européen de la concurrence (Domat Montchrestien, 2013 and 2018).

Isabelle de Silva is the President of the French Competition Authority (Paris).

Between 1999 and 2000, she worked at the French Ministry of Culture and Communication. From 2005 to 2008, she was Deputy Reporter at the Conseil constitutionnel (the French constitutional court).

As government commissionner, she worked at the court of conflicts (2006-2009) and at the French Council of State (2000-2009). From 2009 to 2011, she was legal director of the French Ministry of ecology, sustainable development, transport and housing.

After serving as member of the French regulatory Authority for press distribution (2012), and then as president of the Sixth subsection of the Administrative Jurisdiction Division of the Council of State (2013), she became member of the French Competition Authority in 2014.

Alexandre de Streel is the Academic Director of the digital research programme at the Brussels think-tank Centre on Regulation in Europe (CERRE), professor of European law at the University of Namur and visiting professor at the College of Europe (Bruges) and SciencesPo Paris. He sits in the scientific committees of the Knight-Georgetown Institute (US), the European University Institute-Centre for a Digital Society (Italy) and the Mannheim Centre for Competition and Innovation (Germany).

His main research areas are regulation and competition policy in the digital economy (telecommunications, platforms and data) as well as the legal issues raised by the developments of artificial intelligence. He regularly advises the European Union and international organisations on digital regulation.

Previously, Alexandre held visiting positions at New York University Law School, the European University Institute in Florence, Panthéon-Assas (Singapore campus), Barcelona Graduate School of Economics and the University of Louvain. He also worked for the Belgian Deputy Prime Minister, the Belgian Permanent Representation to the European Union, and the European Commission. He has also been the chair of the expert group on the online platform economy, advising the European Commission.
